During the forum, we set out and agreed on the framework for the signing of an international partnership agreement between the Arbitration Courts in Sofia and Paris. We hope that these relations will be in full benefit to the French business in Bulgaria as well as to the Bulgarian companies working in France. We have not yet discussed all the parties to the agreement. But I can imply that it will be entirely for the benefit of the business.
How did the work of the Sofia Arbitration Court last year? Could you say how many are the cases and how many of them have concluded agreements?
Generally, alternative dispute resolution at the Arbitration Court helps businesses in three ways – it is faster, cheaper and more efficient. More than 70 cases of construction companies were filed against their counterparts in the past year. In the course of the proceedings itself, 40 of them ended with agreements. This is very important because it keeps good business relations between traders. The remaining cases were closed with decisions taken within 4 to 6 months, which is considerably shorter than that of the state court. There is a production between a year or two and sometimes three. For business, time is of great importance.
What is going on in the CAC’s work?
Пред нас на първо време предстои подписването на това международно споразумение. То е от изключително значение за съдебната ни система. Всички дела, които поема арбитражът, облекчават съдебната система. Не на последно място той помага на бизнеса с оглед бързината, известно е, че доста от търговците в хода на производството в държавния съд изпадат в несъстоятелност, тъй като това е много дълъг и разточителен процес.
Кой може да се възползва от процедурите, които предлага Арбитражният съд?
На първо място това е търговецът, както и гражданите. Ще припомня, че нашето законодателство е обърнало внимание и на колективните трудови спорове. Те са предмет на арбитражна институция, само че тя е към министъра на труда и социалната политика.
Какво бихте посъветвали бизнеса, защото знаем, че проблемът с междуфирмената задлъжнялост си остава един от най-сериозните и той до голяма степен затруднява коректните компании?
Бих посъветвала да потърсят този алтернативен способ, тъй като арбитражът има за цел да реши даден спор и задължително да има постановен акт. Алтернативното разрешаване на конфликти е добър пример за това как търговците могат да запазят бизнеса си, добрите отношения и да направят наистина един по-малък разход.
Как работите с Камарата на строителите в България (КСБ) и предвиждате ли бъдещи съвместни дейности?
Проведохме вече няколко срещи с КСБ. Част от тях се случиха по Областните представителства. Нашето желание беше да запознаем членовете на Камарата с предимствата и да им покажем добрите практики на това как арбитражът може да помогне на междуфирмените спорове. Знаете, че през 2014 г. и 2015 г. имаше наистина много подобни проблеми в строителния бранш. Тогава САС помогна. Смятам, че и в бъдеще можем да работим съвместно и моето желание е активно да помагаме на строителния бранш.
Арбитражният съд има много опции да бъде полезен с добри практики, или с прецизна информация относно европейското законодателство. Както виждате, вече имаме международни партньори.
